Terms & Conditions
Last updated: June 2025 · Effective date: June 2025
These Terms and Conditions govern the relationship between Lineara ("we", "us", "our") and any individual or household engaging our services or accessing our website. Please read them carefully before using our services. By making an enquiry, booking a session, or using our website, you agree to these terms.
1. Definitions
- "Lineara" means Lineara, a business registered and operating from 73 Nimmanhaemin Road, Suthep, Mueang, Chiang Mai 50200, Thailand.
- "Service" means any session, workshop, or programme offered by Lineara, including the Generations Conversation Session, Records & Keepsakes Workshop, and Continuity & Care Programme.
- "Client" means the individual or family who engages a Service.
- "Session Materials" means summaries, reference documents, or organisational systems produced during the course of a Service.
- "Agreement" means these Terms and Conditions together with any written booking confirmation.
2. Acceptance of Terms
By booking or using any Service, you confirm that you are aged 18 or over, have the legal capacity to enter this Agreement, and accept these terms on behalf of yourself and, where applicable, your household. If you book on behalf of another individual, you confirm you have their authority to do so.
3. Service Description
Lineara provides facilitation, organisational, and record-structuring services for families. Our Services are purely educational and organisational in nature. Specifically:
- We do not draft or review legally binding documents.
- We do not provide legal, financial, tax, or medical advice.
- Where professional advice is identified as necessary, we will assist in identifying appropriate specialists.
- Services are available primarily in Chiang Mai, Thailand. Remote or travel-based arrangements may be discussed separately.
4. Client Responsibilities
Clients agree to:
- Provide accurate information relevant to the Service.
- Attend agreed sessions or provide reasonable notice of cancellation (see Section 6).
- Treat Lineara facilitators with respect throughout the engagement.
- Not use Session Materials for any unlawful purpose.
5. Intellectual Property
The frameworks, methodologies, templates, and processes used by Lineara in delivering Services remain the intellectual property of Lineara. Session Materials produced during an engagement and containing your family's personal information are for your household's use. You may not reproduce, distribute, or commercially exploit Lineara's proprietary frameworks without our written permission.
6. Payment Terms
- All fees are quoted and payable in Thai Baht (฿).
- Payment is due in full prior to the first session of each engagement unless otherwise agreed in writing.
- Cancellation: cancellations made 48 hours or more before a scheduled session will receive a full refund. Cancellations within 48 hours are non-refundable, though sessions may be rescheduled once at no charge.
- The Continuity & Care Programme fee covers the agreed three-month scope. Requests to extend the programme will be quoted separately.
7. Disclaimers
Our Services are provided in good faith and on the basis of information available to us. However:
- We make no representations about the legal effect of any Session Materials produced.
- We do not warrant that Services will resolve all family or documentation challenges.
- Any referrals to external professionals are made in good faith; we are not responsible for the conduct or advice of those parties.
8. Limitation of Liability
To the extent permitted by Thai law, Lineara's liability for any claim arising from a Service is limited to the fee paid for that specific Service. We are not liable for indirect, consequential, or special losses, including any loss arising from decisions made based on Session Materials. Nothing in these terms limits liability for personal injury caused by negligence or for fraud.
9. Confidentiality
All personal and family information shared during a Service engagement is treated with strict confidence. Lineara does not disclose session content to third parties except where required by law or with your express written consent. Our facilitators operate under internal confidentiality obligations. Session records are retained securely and not shared beyond the engaged household.
10. Termination
Either party may end an engagement in writing. If a Client terminates a multi-session programme early, fees already paid for completed sessions are retained; fees for sessions not yet delivered will be refunded on a pro-rata basis. Lineara may terminate an engagement if a Client acts in a way that is abusive toward facilitators or provides materially false information. Confidentiality obligations survive termination.
11. Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, both parties agree to first seek resolution by direct discussion. If resolution cannot be reached informally within 30 days, disputes will be referred to the competent courts of Chiang Mai Province.
12. General Provisions
- Entire agreement: these terms, together with any written booking confirmation, constitute the full agreement between the parties.
- Severability: if any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: failure to enforce a provision on one occasion does not waive the right to enforce it subsequently.
- Changes: we may update these terms at any time. Material changes will be communicated via our website. Continued use of Services after an update constitutes acceptance.
